Steve Badger has been getting a lot of “word of mouth” discussion by roofers, public adjusters and policyholder attorneys. Next Wednesday afternoon at the TAPIA conference in Austin, I will be on a panel with Steve discussing many ethical issues involving claims adjustment. It has generated a lot of questions, comments and controversy. Some have questioned why Badger should be invited by TAPIA to be on a panel discussing ethics. Others have complained to attorneys in my firm that I… [read post]

Lifetime Achievement Awards usually come at the end of a career. That was my first thought when I was surprised by the Florida Association of Public Insurance Adjusters granting me such an honor at their annual convention this week. My second thought was that a lot of people die not long after they get one of these things. For example, Henry Fonda received lifetime achievement awards from the Kennedy Center, Golden Globes, and The Academy of Motion Pictures in 1979, 1980, and 1981 respectively. He… [read post]

Appraisal was the topic of conversation between Steve Badger and me at the Denver IAUA conference. Colorado appraisals have been a matter of much litigation and controversy in Colorado. For some reason, appraisal law has been in great flux and controversy in Colorado versus the vast majority of states where appraisals seem to go along...… Continue Reading . [read post]

I have been in a networking seminar regarding Safeco and Liberty Mutual insurance companies all day. One of my colleagues provided me some materials from State Farm. I am posting a couple of them for your review. The important aspect of these internal documents is how close State Farm comes to complete agreement with me regarding the obligations of good faith claims conduct. Susan Hood, the top claims official for State Farm indicated in part: • Explaining coverages. It's such an important… [read post]

Steve Badger was a good sport before and after our presentation at TAPIA's Fall meeting last week. Here's a picture of us after the event: I personally think it is difficult to keep saying "no" to almost anything or anybody. Insurance claims adjusters seem to find a way to do it when the result is a second disaster for the policyholder. Some insurance company attorneys seem to sadistically enjoy it – I guess it is because they enjoy taking that position. Others look at it… [read post]
