Today I filed an amicus brief in Duncan v. Beccaria, a challenge to a California statute confiscating almost all magazines over 10 rounds. Last summer, a federal district court issued a temporary injunction against the confiscation statute. The case is now before a panel of the 9th Circuit Court of Appeals. Yesterday a firearm and magazine confiscation ordinance in the Chicago suburb of Deerfield was blocked on by a temporary restraining order. The Lake County Circuit Court held that the ordinance violates a state preemption statute. The court's opinion is attached to this post. Procedural history: The Deerfield ordinance was enacted on April 2, 2018. Its effective date would have been June 13, today. Two lawsuits have challenged the oridinance. Can a county prohibit all new gun stores within its jurisdiction? That question is currently before the U.S. Supreme Court, in a petition for certiorari. Today I filed an amicus brief arguing that the Court should grant cert. The case began several years ago, when Alameda County forbade John Teixeira and his partners to open a gun store anywhere within the jurisdiction of the county.
