I feel it is my duty to link to this post so more people will know what a rude b-person Ahriahhnahh Huffington is.  I'm really glad this didn't happen to me.  I am susceptible to line rage.  I probably would have chased after her yelling "It's Zha Zha, and she has cut the line in front of me, dahhhling!"  I like to think I would have had the good judgment not to tackle her, but I'm not sure.  [read post]

Well, here's a shocker.  I don't really agree with Orin Kerr and Andrew Sullivan that the ban on travelers with HIV coming to the US should be lifted, or that it is "absurd."  It certainly is not absurd.  Absurd means something that is against reason, that flies in the face of reason.  Public health restrictions on travel have apparent reasons.  They are there to inhibit the spread of disease.  I would be surprised if… [read post]

So EBay has a minority stake in CraigsList.  EBay also owns one of CraigsList's biggest competitors.  Craig of CraigsList, does not want EBay represented on the board of directors of CraigsList.  As far as I can tell, EBay does not have any special rights to be represented on the board of CraigsList.  Now, taking some steps not described in the article, so I could be wrong, CraigsList is trying to make sure that EBay is not represented on the CraigsList… [read post]

We are a rockin' family and I didn't even know it.  After much insistence, we just bought this for Patrick, the musician in our midst.  He already plays the pianner. His best friend has an electric guitar.  They both know a guy with a bass.  You can see where this is going. But consider.  It is a far, far better thing for kids to do than what they could be doing.  It is the rock 'n' roll part of the famous triad, and the… [read post]

Today is the sixth anniversary of the death of Brian Gillis, the son of my former secretary here at USD. This is a very sad story, first in the terrible loss itself, and second in how difficult it often is for crime victims to get any measure of justice.  [read post]

That is "typical white person", of course.  I believe I am the first to use TWP, so if possible, please give me credit if you repeat it.  A link to this blog or a payment sent to me will do fine.  Yes, it is obvious, but somebody still has to be first.  For those of you still spending time in that sensory deprivation tank you bought in the '80's, "typical white person" is a phrase Senator Obama used to describe an… [read post]

I am not getting any schadenfreude out of Spitzer's downfall.  Indeed, one of the things I dislike about this scandal is that it is sufficiently ugly and pathetic to ruin a little innocently shameful joy in the comeuppance of a hypocrite.  What makes his behavior so blameworthy as Professor Rapport and his lovely wife have pointed out, and indeed also my sister (a prosecutor in Utah), is the effect all of this is having on his wife and three daughters.  One cannot… [read post]

What is wrong with these people?  Here's a brilliant thought.  If you are a prominent public official, don't have sex with a prostitute.  Many would argue it's not a good idea, even if you are not a public official.  Hardened types I know, who would not hesitate to say, bludgeon an armed robber to death with a tire iron, so not your squeamish, too nice types, have said, just fuggetaboudit, too much trouble, too dangerous, too many things that can go… [read post]

So now apparently anybody who dares mentions Senator Obama's middle name is attempting to play on our fears.  "He who must not be middle-named" is funny.  I hope we can at least allow that without getting into trouble. But my point is broader.  What's so bad about fear?  Fear is nature's way of telling you to watch the f@&% out.  I'm afraid of lots of things, and all of them quite merit my fear as far as I… [read post]

I think this is pretty nifty:  A PreCYdent widget you can put on your blog, webpage, or wherever, so you can go directly into our search system and look for US Supreme Court or US Court of Appeals cases, and later, lots of other stuff.   Want more? Go to [www.precydent.com] You too can have a PreCYdent widget, and really, don't you think you should?  If you have this widget on your legal blog, your readers can go to the library and see for… [read post]

As you may have heard, Robert Plant's and Alison Krauss's collaboration Raising Sand is something special.  It is being hyped, true, but that doesn't mean it's not really good.  Legendary LZ vocalist meets legendary country singer.  As you would expect, almost all of the songs, all covers of great numbers, are rip out your heart and stomp that sucker flat sorts.  But that works for me.  I had no idea Plant had the sort of range he… [read post]

I overheard this conversation fragment between my 4 year old Mark and my 11 year old William:  W:  "A living thing?  Well, an ant is a living thing, a dog is a living thing, a man is a living thing .  A living thing moves by itself . . . "M:  "Is a fan a living thing?"W:  "No, a fan only moves because electricity makes it move.  A living thing has organs.  Like your tummy. … [read post]

Also this:  Lesbian couple married in Massachusetts cannot divorce in Rhode Island because RI does not recognize Massachusetts gay marriages.  Nor can they divorce in Massachusetts because that state has a residency requirement.  Thus they have a traditional marriage.
