Two 2019 alumni of Berkeley Law School, Nir Maoz and Olivia Wittels, are concerned that the recent attention given to the "no speakers who support Israel's existence" rule adopted by nine student groups at the law school is giving people a false impression of the school. Jewish and Zionist students at Berkeley Law, they write, are thriving. They describe their own experiences in support of that claim. I don't doubt they are right about the thriving part, but after I finished the… [read post]

[The American Indian Law Review at University of Oklahoma accepted an article, and then withdrew its acceptance on dubious, and obviously political grounds.] The Indian Child Welfare Act is a well-intentioned law that has gone terribly wrong. Intended to protect Native American children from overzealous, sometimes racist officials who were historically way too keen to terminate Native Americans' parental rights, in practice it is itself a racist law. I discuss some of the problems with the ICWA… [read post]

[Hamasnik protestors are violating various federal laws, and the Justice Department is doing nothing about it] [Cross-posted with my Times of Israel blog] As Times of Israel readers are well-aware, since October 7, anti-Israel groups have launched widespread assaults on the rights of Jewish Americans, especially but not exclusively on college campuses. I regularly tweet (@ProfDBernstein) about these incidents and comment, "Where is the Justice Department? Where is the FBI?" I often get… [read post]

[Note: I'm working on a book chapter with a similar theme, here is an attempt to distill it into blog post-size.] As South Africa hosts its first ever G20 Summit, its continued pursuit of Israel under the false guise of genocide is resulting in growing diplomatic pushback. The United States and Argentina have announced they will not be attending, yet Pretoria continues to weaponize the very term "genocide" to suit its political objectives. South Africa's pursuit of… [read post]

No, this isn't another post about that horrible Nancy MacLean book, but it is related. As an early, vociferous critic of the book, I wound up in email, blog, and Twitter debates with some of her defenders among fellow historians, especially those who purport to specialize in intellectual history. And what I learned from this was troubling. While I'm sure there are many excellent historians around, I found that the historians I interacted with not only tended to reason backwards from their… [read post]

Before Dr. Ford's allegations about Judge Kavanaugh became public, Kavanaugh was poised to be confirmed. If Kavanaugh gets confirmed, a large percentage of the country is going to thing it was rammed through without a proper investigation of serious allegations of sexual assault. If his confirmation is voted down, an equally large percentage of the country is going to believe he was illegitimately denied a seat due to a last-minute character assassination campaign. There is a plausible way out… [read post]

Canary Mission is a controversial, secretive organization dedicated to publicizing extreme anti-Israel and often anti-Semitic views of various activists. Its primary modus operandi is to tweet screenshots of tweets by extemists, such as the one reprinted below. Many people, including some who are otherwise pro-Israel and hostile to anti-Semitism, find Canary Mission's tactics objectionable and counter-productive. (I take no position on the matter.) Among them are pro-Israel students at the… [read post]

A new report out of Columbia University documents abuses of faculty prerogatives and general outrageous misbehavior on the part of full-time faculty, instructors, and graduate assistants. Academic freedom does not include being abusive to students, using your classes for political organizing, teaching material unrelated to your classes ideological reasons, and otherwise treating your classroom position as if its your personal platform to pursue an ideological agenda. All of these teachers should… [read post]

Smith: I feel like I owe libertarians an apology, for severely underrating their ideology. I was so focused on its theoretical flaws that I ignored its political importance. I concentrated only on the marginal benefits that might be achieved by building on our economic system's libertarian foundation, ignoring the inframarginal losses that would happen were that foundation to crumble. I had only a hazy, poor understanding of the historical context in which… [read post]

An exposé at the Washington Free Beacon reveals thorough DEI corruption at the Harvard Law Review. As summarized by author Aaron Sibarium, "the Harvard Law Review has made DEI the 'first priority' of its admissions process. It routinely kills or advances pieces based on the author's race. It even vets articles for racially diverse citations." I had to chuckle at this one: "In a section titled 'Why should they write the foreword?', one 2024 spreadsheet… [read post]
