The Solicitor General has filed an application for a stay with the U.S. Supreme Court. The requested stay would be of a judgment entered by the U.S. District Court for the Southern District of Texas, but the real showdown here is between the Fifth Circuit and the Sixth Circuit. Last week they issued directly contrary decisions in cases about the Department of Homeland Security's September 2021 guidance about the enforcement of immigration laws. The issues include state standing, the… [read post]

This morning the Supreme Court will hear argument in Lackey v. Stinnie, a major case about attorneys's fees and preliminary injunctions. The case has so far escaped much attention in the press, but its implications are important. These include implications for litigation funding, for incentives to settle after a preliminary injunction, and for how the preliminary injunction operates in the federal courts. The current draft is available on SSRN. Earlier posts described the doctrine of remand without vacatur and argued that as applied to regulations imposing duties of conduct on private people the doctrine rests on a false premise. Courts that embrace the doctrine assume that unlawful… [read post]

Chief Justice Roberts has issued a stay of the district court's order in Arizona v. Mayorkas. The bottom line is that the vacatur of the "Title 42" immigration order is on hold for now, with a very tight deadline for a response from the federal government. You can read more details in this Politico story. Here's a link to my earlier discussion of this case, including the tension between one court's vacatur and another court's national injunction. The… [read post]
