[Trump has a constitutional right to do business in New York] New York State Attorney General Letitia James' lawsuit against Donald Trump is unconstitutional and unfair. James is demanding that Trump, his business, his two oldest sons, and two business partners give back $370 million that she says they obtained through fraud. James wants to permanently ban Trump from running a business in New York State. And, she has obtained a ruling from the judge trying the case to place all of Trump's… [read post]

[My thoughts on this opinion.] After an incredibly busy week, I finally had time today to read carefully Judge Aileen Cannon's opinion in United States v. Trump. I thought it was excellent, indeed better than most Supreme Court opinions on the Appointments Clauses (although entirely consistent with those opinions). I might be biased given that Judge Cannon's opinion cited Gary Lawson's and my law review article on this topic, but she went way beyond that article. President Trump… [read post]

[Section 3 of the Fourteenth Amendment and the Incompatibility Clause both apply to "officers under the United States" and must thus mean the same thing] The oral argument today in Trump v. Anderson strongly suggests a Trump victory on the grounds advanced heroically by Josh Blackman and Seth Barrett Tillman. Many kudos to them both for the long and successful  campaign that they have waged.  The Court will likely reverse the Colorado Supreme Court based… [read post]

[Nikki Haley is libertarianism's best bet.] I consider myself to be a libertarian conservative with a Reaganite view of foreign policy. The Iowa Caucuses are now only ten days away, and it is appropriate to evaluate the merits of some of the Republican presidential primary contenders at this time given my viewpoints. I will comment on what I think are the strengths and weaknesses of each candidate given my own political philosophical perspective. Donald Trump. Donald Trump was in many ways a… [read post]

[Bribery is a High Crime and Misdemeanor] On Dec. 7, 2023, a federal grand jury filed an explosive indictment that charged Hunter Biden with a scheme to evade taxes on millions of dollars in income from foreign businesses.  Prior to this, he was charged with violating federal law by lying about his drug usage on a federal form, and he was administratively discharged by the U.S. Navy for failing a drug test on his first day at work—a job which Vice President Joe Biden had helped him to… [read post]

[A Stalinist nightmare in New York State] Donald Trump has been ordered to pay a $355 million fine and has been barred from doing business in New York State for three years.  Judge Arthur Engoron ordered Trump to pay essentially all of his cash reserves of $400 million, which fine if upheld would force Trump to sell some of his real estate holdings to raise cash to live on.  Once interest is added on the total fine will rise to $450 million.  This is all on top of an $83.3 million… [read post]

[The Supreme Court held today that the Seventh Amendment right to a civil jury trial in fraud cases was violated when an administrative law judge of the S.E.C. decided the case.] Chief Justice Robert wrote an excellent, thorough, and overwhelmingly persuasive majority opinion in S.E.C. v. Jarkesy, 603 U.S. __ (2024), holding that the Securities and Exchange Commission could not try civil fraud suits before its own Administrative Law Judges. It must instead try them in federal District Court where… [read post]

Barr, together with me and B.U. law professor Gary Lawson, and with Citizens United, joined an amicus brief that was filed yesterday on Donald Trump's side in Trump v. Anderson.  This is the case which the Supreme Court is hearing on whether former President Donald J. Trump is disqualified from being re-elected as President… [read post]

[116 people have served on the Supreme Court and Justices Thomas is the best] Justice Clarence Thomas has served for 32 years on the U.S. Supreme Court where he has been a consistent originalist who has led the Court to move in his direction on issues as varied as the Confrontation Clause; federalism; executive power; and the reining in of the administrative state.  He has written hundreds, if not thousands, of opinions, and one thing is apparent from all of them that I have read.  They… [read post]

[Democrats tried to alter unconstitutionally the membership of the Supreme Court; they extorted Facebook into censoring free speech; they issued presidential executive orders unsupported by statute; and they pushed unprecedented prosecutions of Biden's predecessor in office, and his 2024 opponent, in the presidential race.] Democrats are accusing President Trump of undermining judicial independence by not following court judgments in immigration cases. Put aside that, as of yet, it is far from… [read post]

[The house of representatives should pass a bill allowing former president trump to remove both his New York criminal and civil cases to federal court] I taught Federal Jurisdiction for at least fifteen years at Northwestern Law School, from 1990 to 2005, and I have written several law review articles on this subject. I have long admired the federal removal statutes, which allow allow federal officers and persons acting under a law of the United States to remove their cases from state to federal… [read post]
